MARKETING COMMUNICATIONS POLICY

This Marketing Communications Policy ("Policy") explains how Five Class Automotive Detailing ("we," "our," or "us") handles marketing communications and your rights regarding such communications. This Policy is designed to comply with applicable federal and state regulations, including but not limited to the Controlling the Assault of Non-Solicited Pornography And Marketing Act ("CAN-SPAM Act"), codified at 15 U.S.C. § 7701 et seq., the Telephone Consumer Protection Act ("TCPA"), codified at 47 U.S.C. § 227, and Oregon state consumer protection laws, including ORS 646.605 et seq. This Policy supplements our Privacy Policy and Terms of Use.

2.1 Types of Marketing Communications

Five Class Automotive Detailing may send the following types of marketing communications, all of which comply with applicable federal and state regulations:

We will only send you marketing communications if you have provided express consent. Consent may be obtained through:

  • Selecting the "Marketing Messages" option in our quote request form
  • Explicitly opting in to receive marketing communications
  • Providing consent through other written or electronic means

3.2 Separate from Service Communications

Your consent to receive marketing communications is separate from service-related communications. Even if you opt out of marketing communications, we may still contact you regarding:

  • Active service requests and appointments
  • Service confirmations and reminders

4. Opting Out of Marketing Communications

4.1 How to Opt Out

Pursuant to the CAN-SPAM Act (15 U.S.C. § 7701 et seq.) and the TCPA (47 U.S.C. § 227), you may opt out of receiving marketing communications at any time through any of the following methods:

  • Email: Click the "unsubscribe" link at the bottom of any marketing email, as required by the CAN-SPAM Act
  • SMS/Text: Reply "STOP" to any marketing text message, as required by the TCPA
  • Phone: Call us at (541) 214-5352 and request to be removed from marketing lists
  • Email Request: Send an email to tyskidmore90@gmail.com with "Unsubscribe" in the subject line

4.2 Processing Time

In compliance with the CAN-SPAM Act, we will process your opt-out request as soon as reasonably possible, typically within 10 business days. You may continue to receive marketing communications during this processing period, but we will honor your request promptly thereafter.

4.3 Effect of Opt-Out

Opting out of marketing communications will:

  • Stop all future marketing emails and promotional messages
  • Stop marketing SMS/text messages (if you have opted in to SMS), in compliance with TCPA requirements
  • Not affect service-related communications, which are transactional in nature
  • Not affect communications required by law or for account security

5. SMS/Text Message Communications

5.1 SMS Consent and TCPA Compliance

In compliance with the Telephone Consumer Protection Act ("TCPA"), codified at 47 U.S.C. § 227, and its implementing regulations, if you have selected SMS notifications in our quote request form, you provide express written consent to receive text messages from Five Class Automotive Detailing. Message frequency varies. Message and data rates may apply. By providing your mobile telephone number and selecting SMS notifications, you acknowledge that you are the subscriber to the mobile telephone number provided or that you have authorization from the subscriber to provide such consent.

5.2 SMS Opt-Out

Pursuant to TCPA requirements, you may opt out of receiving SMS messages at any time by replying "STOP" to any text message from Five Class Automotive Detailing. For help, reply "HELP" to (541) 214-5352. After texting "STOP," you will receive one final confirmation message confirming your opt-out request. Once you opt out, you will no longer receive marketing text messages, but you may continue to receive service-related transactional messages.

5.3 Carrier Information

Carriers are not liable for delayed or undelivered messages. We are not responsible for any charges imposed by your mobile carrier for receiving text messages. Standard message and data rates may apply as determined by your mobile carrier.
