1. Acceptance of Terms

By accessing, using, or interacting with Five Class Automotive Detailing's website, services, or by submitting a quote request form, you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"). These Terms are subject to applicable federal and state laws, including but not limited to Oregon's Unfair Trade Practices Act (ORS 646.605 et seq.) and federal consumer protection regulations. If you do not agree to these Terms, you must not use our services or submit information through our website.

2. Service Description

2.1 Mobile Service

Five Class Automotive Detailing is a mobile automotive detailing service that provides services at customer-specified locations. We bring all necessary equipment, supplies, and personnel to your location to perform automotive detailing services.

2.2 Service Exceptions

While Five Class Automotive Detailing operates as a mobile service, certain circumstances may require services to be performed at alternative locations, including but not limited to:

  • Weather conditions that make mobile service unsafe or impractical
  • Location restrictions or limitations that prevent mobile service
  • Specialized services that require fixed-location facilities
  • Customer preference for alternative service location
  • Emergency situations or force majeure events

In such cases, Five Class Automotive Detailing reserves the right to request that services be performed at an alternative location, and will provide reasonable notice to the customer when possible.

3. Quote Request and Consent to Contact

3.1 Form Submission and Consent

By submitting a quote request form on our website and clicking "Get My Quote" or similar confirmation button, you expressly consent and agree to the following:

  • You consent to be contacted by Five Class Automotive Detailing via the communication methods you have selected in the form (including but not limited to phone, email, SMS/text message)
  • You consent to receive communications related to your quote request, service inquiries, appointment scheduling, and service-related information
  • Your consent is based on the specific communication preferences you selected in the form (SMS notifications, marketing messages, etc.)
  • You understand that by submitting the form, you are requesting information and services from Five Class Automotive Detailing

3.2 Communication Preferences

Your communication preferences, as selected in the quote request form, will determine how we contact you. You may update or withdraw your consent at any time by contacting us at tyskidmore90@gmail.com or calling (541) 214-5352.

4. Deposits and Payment Terms

4.1 Required Deposit

A non-refundable deposit of $50.00 USD is required to secure and confirm all service appointments with Five Class Automotive Detailing. This deposit:

  • Must be paid before the scheduled service date
  • Will be applied toward the total service cost
  • Is non-refundable except as required by law or as otherwise specified in these Terms
  • Secures your appointment time slot

4.2 Additional Vehicle Deposits

For each additional vehicle beyond the first vehicle, an additional $50.00 USD deposit is required per vehicle. Multiple vehicle appointments require separate deposits for each vehicle to be serviced.

4.3 Additional Fees for High-Value Services

Five Class Automotive Detailing reserves the right to require additional fees, deposits, or payment arrangements for specific high-value services, including but not limited to:

  • Ceramic coating applications
  • Paint correction services
  • Extensive restoration work
  • Specialty or custom services
  • Services requiring specialized equipment or materials

Any additional fees or deposit requirements will be disclosed to you before service is performed and will be included in your written quote or service agreement.

4.4 Payment Methods

We accept cash, check, Visa, MasterCard, American Express, Discover, PayPal, Venmo, and Zelle. Final payment is due upon completion of services, unless other arrangements have been made in writing.

5. Liability and Work Orders

5.1 Work Order Requirement

Five Class Automotive Detailing reserves the right, at its sole discretion, to require customers to complete and sign a liability waiver and/or work order form before performing or providing services. This requirement may apply to:

  • High-value vehicles or specialty vehicles
  • Services involving significant vehicle modifications or custom work
  • Vehicles with pre-existing damage or conditions
  • Services requiring specialized techniques or equipment
  • Any situation where Five Class Automotive Detailing determines a work order is necessary to protect both parties

5.2 Work Order Content

The work order may include, but is not limited to:

  • Description of services to be performed
  • Vehicle condition assessment
  • Liability limitations and waivers
  • Service terms and conditions
  • Customer acknowledgment of vehicle condition

5.3 Refusal of Service

Five Class Automotive Detailing reserves the right to refuse service if a customer declines to sign a required work order or liability waiver. In such cases, any deposit paid may be forfeited if the refusal occurs after the service appointment has been scheduled.

6. Service Limitations and Disclaimers

6.1 Service Results

While Five Class Automotive Detailing strives to provide high-quality services, results may vary based on vehicle condition, age, previous treatments, and other factors beyond our control. We do not guarantee specific results or outcomes.

6.2 Pre-Existing Conditions

Five Class Automotive Detailing is not responsible for pre-existing damage, defects, or conditions on your vehicle. We will document and note any pre-existing conditions before service begins when possible.

6.3 Limitation of Liability

To the maximum extent permitted by law, Five Class Automotive Detailing's total liability for any claims arising from or related to our services shall not exceed the total amount paid by the customer for the specific service giving rise to the claim. Five Class Automotive Detailing shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

7. Cancellation and Rescheduling

7.1 Customer Cancellation

If you need to cancel or reschedule an appointment, you must provide at least 24 hours' notice. Cancellations with less than 24 hours' notice may result in forfeiture of your deposit.

7.2 Service Provider Cancellation

Five Class Automotive Detailing reserves the right to cancel or reschedule appointments due to weather, equipment failure, emergencies, or other circumstances beyond our control. In such cases, deposits will be refunded or applied to rescheduled appointments.

8. Customer Responsibilities

You are responsible for:

  • Providing accurate vehicle information and service requirements
  • Ensuring safe and legal access to the service location
  • Providing access to water and electricity if required for service
  • Removing personal items from your vehicle before service
  • Being present or available during service, if required
  • Paying all fees and deposits as agreed

9. Intellectual Property

All content, materials, logos, and intellectual property on Five Class Automotive Detailing's website and marketing materials are the property of Five Class Automotive Detailing and are protected by copyright, trademark, and other intellectual property laws.

10. Modifications to Terms

Five Class Automotive Detailing reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

11. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions. These Terms are subject to Oregon's Unfair Trade Practices Act (ORS 646.605 et seq.) and other applicable Oregon consumer protection statutes. Any disputes arising from or related to these Terms or our services shall be resolved in the state or federal courts located in Lane County, Oregon. Nothing in these Terms shall limit or waive any rights or remedies available to consumers under applicable federal or state law.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms of Service, together with any work orders, quotes, or written agreements, constitute the entire agreement between you and Five Class Automotive Detailing regarding the subject matter herein.
